Thank you for your interest in a ZERMATTERS activity. We kindly ask you to take note of the following general terms and conditions:
Unless expressly agreed otherwise, these terms and conditions apply to all transactions between ZERMATTERSĀ® and customers.
The object of the company is the operation of a snow sports, bike and mountain sports school as well as the provision of mountain guides, hiking guides and paraglider pilots. In the following, ski instructors, snowboard instructors, mountain guides, hiking guides, bike guides and paraglider pilots are generally referred to as course instructors.
1. booking
Registration is mandatory for all ZERMATTERS offers. Bookings can be made in writing, by telephone, electronically or in person at the ZERMATTERS or other sales outlets selling the ZERMATTERS offers. By registering, the customer accepts the General Terms and Conditions as an integral part of the contract between him/her and the ZERMATTERS.
Any wishes and concerns regarding eating habits, medical prophylaxis, etc. must be communicated in advance so that the instructor can take the necessary measures.
2. minimum number of participants for group courses
Unless otherwise stated, the minimum number of participants for group courses is 3.
If the group size falls below this number of participants, ZERMATTERS reserves the right to combine groups, shorten courses, cancel courses at short notice or make you an alternative offer for an additional charge.
3. prices
The prices quoted are in Swiss francs. If payment is made in EURO, the corresponding daily exchange rate of the service provider will be applied. Prices are subject to change without notice.
The prices include the cost of the lesson, course or tour. In general, the prices do not include personal catering, rental equipment, accommodation costs or transportation costs (mountain railroads), unless otherwise stated in the detailed description of the offer.
4 Terms of payment
The total amount of the agreed service is due before the start of the activity. The following advance payments are due for the following selected offers in the Climb area:
- For multi-day tours or tours of 2 days or more (excluding the Matterhorn), a deposit of CHF 100 per booking will be charged.
- A deposit of CHF 150.00 will be charged for the Matterhorn climb.
- Deposits paid will not be refunded if the customer cancels or if the tour is not carried out due to bad weather.
- Deposits will be deducted from the total amount of the booking.
5 Cancellation or change of order by the customer
Cancellation of the contract by the customer before the start of the activity can be notified by e-mail, telephone or directly to the ZERMATTERS sales office.
- The booked course cannot be postponed
- Each lesson or group course commenced will be charged in full.
The following cancellation conditions apply:
(Ski, Board, Bike, Climb, Hike, Fly)
- 14 days to 48 hours before the start of the course: CHF 50 processing fee per booking
- from 48 hours to the start of the course: the full course price will be charged
(multi-day offers / multi-day tours from 2 days)
- Up to 48 hours before the start of the course: CHF 100.- (exception Matterhorn CHF 150.-)
- From 48 hours to the start of the course: the full course rate will be charged
(Package deals or course incl. accommodation/camps)
- 30 to 15 days before the start of the course: 30% of the course costs
- 14 to 7 days before the start of the course: 50% of the course costs
- 6 days or more before the start of the course: 100% of the course costs
(advertised group offers with required number of participants*)
- 14 to 4 days before the start of the course: 50% of the course costs
- from 3 days before the start of the course: 100% of the course costs
*These cancellation conditions apply if the minimum number of participants or the course has already been guaranteed at the time of cancellation.
The start of the activity is always the first day of the booked service.
There is no entitlement to a refund if:
- the activity cannot be carried out due to delay or non-appearance of the customer. Additional costs incurred due to the postponement or late arrival of the customer shall be borne by the customer.
- the customer only starts an activity after it has begun or leaves it before it ends.
- the customer does not make use of individual days in the case of multi-day bookings.
For the repayment of canceled reservations, we use the same means of payment that was used for the original transaction, unless expressly agreed otherwise.
6 Cancellation or change of order by ZERMATTERS before the start of the activity
ZERMATTERS reserves the right to change, cancel or terminate the program or individual services after conclusion of the contract and also during the activity if natural and/or weather conditions or other unforeseen circumstances (force majeure, official measures, security or other risks) make this necessary. The ZERMATTERS also reserve the right to cancel activities if the minimum number of participants is not reached.
If a significant change is made to the program which the customer does not wish to accept or if the customer refuses to rebook an equivalent replacement activity, the payments made will be refunded less the services already used. Claims for compensation are excluded.
7 Change of program or cancellation of the activity after the start of the activity
ZERMATTERS reserves the right to change the activity program or individual agreed services if external circumstances (e.g. force majeure, weather and natural conditions, official measures or safety risks) make this necessary.
In the case of the following events, the customer will be refunded the payments made less the expenses already incurred:
- Closure of tourist service providers such as mountain railroads, trains, hotels or restaurants due to official measures (e.g. pandemic).
There is no entitlement to a refund:
- Closure of tourist service providers such as mountain railroads, trains, hotels or restaurants due to weather or natural conditions (e.g. official storm warnings.)
- Illness or accident of the customer
8. conditions of participation
Good health is a prerequisite for all activities. The participant undertakes to inform ZERMATTERS of any health problems. The customer undertakes to strictly follow the instructions of the instructors and assistants. If a participant does not fulfill these conditions of participation or does not follow the instructions, ZERMATTERS reserves the right to exclude him/her from the activity. In the event of exclusion, the customer is not entitled to a refund.
9 Liability
ZERMATTERS accepts no liability for accidents during lessons, tours, tests and competitions. The instructor cannot guarantee absolute safety from the objective dangers in the mountains. The customer accepts the inherent residual risk of the outdoor activity, which remains despite careful and prudent management.
Claims for damages due to errors in illustrations, prices and texts are strictly excluded.
10. insurance
Insurance (health and accident insurance including sports accidents) is the responsibility of the participant. We recommend taking out cancellation costs and return transportation insurance.
11 Complaints
Complaints or any damage suffered must be submitted to ZERMATTERS in writing by post or e-mail(info(at)zermatters.ch) within four weeks of the end of the activity. If a claim is submitted late, all claims shall lapse.
12. photographic material
ZERMATTERS reserves the right to use any photographic material for marketing purposes. You can revoke your permission to use and pass on the data and images at any time by sending us a corresponding message to info@zermatters.ch. The data required for business transactions will be treated confidentially.
13 Applicable law
The place of performance is the central place of business of ZERMATTERS. The place of jurisdiction is Zermatt and Swiss law applies.
The course or tour is conducted in the name and for the account of the course instructor.
For reasons of readability, the masculine form is used when referring to persons, but the feminine form is always included.
